Getting a denial letter after a storm damage claim is frustrating — but it’s not necessarily the end of the road. Georgia homeowners have several legitimate options to challenge a denial, and many of them work.
Why Claims Get Denied
“Pre-existing condition” — The adjuster determined damage predates the storm. This often happens with older roofs where normal wear looks like storm damage to an untrained eye.
“Cosmetic damage only” — The carrier says damage is purely aesthetic and doesn’t affect function. This gets applied incorrectly when hail bruising actually does compromise shingle integrity.
“Insufficient damage” — The adjuster found fewer than the minimum impacts per square to constitute a covered loss.
“Maintenance issue” — Deteriorated caulking or aged shingles contributed to the damage.
Step 1: Request the Full Claim File
Under Georgia law, you have the right to request your complete claim file — adjuster notes, photographs, and the specific policy language used to justify the denial. Send a written request to your carrier’s claims department.
Step 2: Request a Re-Inspection
Request one in writing. When the second adjuster comes out, have a licensed contractor on-site. The presence of a contractor significantly changes the dynamic.
Bring documentation from your original inspection, NOAA weather data from the storm date, and photos taken immediately after.
Step 3: Invoke the Appraisal Clause
Most Georgia policies contain an appraisal clause — a mini-arbitration process where each side hires an independent appraiser and a neutral umpire decides the disputed amount. This is faster and cheaper than litigation.
Step 4: File a Complaint
File with the Georgia Office of Insurance and Safety Fire Commissioner at oci.ga.gov. Carriers take these complaints seriously — they create regulatory pressure to review the decision.
Step 5: Consult a Public Adjuster or Insurance Attorney
For large claims, a public adjuster (PA) or insurance coverage attorney may be worth engaging. PAs typically charge 10-15% of the final settlement.
Don’t give up after a denial without at least requesting a re-inspection. A significant percentage of denied roof claims are reversed when a contractor is present for the second inspection.
